1. Acceptance of Terms

By accessing or using iArt.ai ("the Service"), operated by iArt AI ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

iArt.ai is an AI-powered motion graphics platform that enables users to create professional animated videos from text prompts, design assets, and audio inputs. The Service includes the web application at app.iart.ai, the marketing website at www.iart.ai, and related APIs.

3. Account Registration

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate, complete information and keep it updated.

4. User Content

You retain ownership of content you upload or create using the Service ("User Content"). By using the Service, you grant us a non-exclusive, worldwide license to process your User Content solely to provide the Service.

You are responsible for ensuring you have the right to use any content you upload, including images, audio, and text. You must not upload content that infringes third-party intellectual property rights.

5. AI-Generated Content

Content generated by the Service using AI ("Generated Content") is provided as-is. We do not guarantee that Generated Content is free from errors, biases, or inaccuracies. You are responsible for reviewing and validating Generated Content before use.

6. Acceptable Use

You agree not to:

  • Use the Service to create harmful, illegal, or misleading content
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Circumvent rate limits or abuse the API
  • Resell or redistribute the Service without authorization
  • Use automated tools to scrape or extract data from the Service

7. Subscription and Payments

Some features require a paid subscription. Pricing, billing cycles, and refund policies are described on our pricing page. We reserve the right to change pricing with 30 days' notice. Subscriptions auto-renew unless canceled before the renewal date.

8. Intellectual Property

The Service, including its design, code, and AI models, is owned by iArt AI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, iArt AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance.
